Terms & Conditions

Our Relationship, Liability and Responsibility :

Cube Retreats,,,, its Owners (also referred as We, Us, Our, Owners), and the Property owner have a Client / Agent relationship and we are acting ONLY as a Booking Agents of the Property Owner. This basic term of business shall set the terms on which accommodation and other services are arranged by us for the Guest (also referred as You, Your, He, Her, They).

Your contract for rental of accommodation is only and only with the Property Owner and NOT with us. We have only acted as an agent / facilitator in the whole transaction. As such we accept no responsibility for provision of the accommodation or quality of accommodation or other services by the relevant Property Owner, and any problem related to the Property faced by you after Checking-In should be reported to the local representative of the Property Owner. You may also call us to facilitate and help resolution of the issue during office hours or through WhatsApp / E Mail.

We or The Property Owner are in NO way liable for any acts of nature or major mechanical / Electrical failure that would limit the use of Property or its facilities.

We or the owners shall not be held responsible in any way for failure or outages of Utilities like Air Conditioning, Heating, Power Supply or water supply etc.

Our websites, brochures and other publicity material or endeavours show and project information and content provided to us by the Property Owners. While we have made all reasonable efforts to verify the correctness and recency of the information, we shall not be held responsible for any variance thereof with actuals. Most of the Properties marketed by us are privately owned for personal use and their furnishings vary and change from time to time depending upon the owners' taste, as a result we cannot guarantee the presence of particular furnishings, equipment or appliances that you may have seen on our website, brochures and other publicity material or endeavours.

Guests explicitly agree to use all facilities and amenities in and around the Property entirely at the Guest’s own initiative, risk and responsibility. Further, Guest hereby Indemnifies as well as waives and releases any claims against Cube Retreats,,,, its Owners, and the Property Owner and their successors, assigns, employees or representatives, officially or otherwise, for any Loss, Injuries or Death that may be sustained by Guest and / or his / her party on or near or adjacent to the Property, including any common facilities, activities or amenities for whatsoever reason/s.

General, Safety and Prohibitions

The Guest shall NOT cause any nuisance to neighbours of the property, shall NOT use the Property for any purpose other than accommodation and shall not use the Property for committing or conducting any unlawful act.

Smoking is PROHIBITED anywhere in the Property. Doing so shall result in forfeiture of entire security deposit and removal of the Guest and his party from the property, at the sole discretion of the Property Owner, without recourse to refund.

Fireworks are ABSOLUTELY PROHIBITED anywhere on the property or around the property.

Open Fires are STRICTLY PROHIBITED anywhere on the property except in fire pits / Bar B Q grills, where provided by property owners.

Consumption, bringing or possession of “DRUGS” by any Guest or member of his party or his visitors is STRICTLY PROHIBITED.

Breach of this condition shall terminate the booking and result in instant and immediate removal of the Guest and his / her entire party from the Property without recourse to any refund of Booking Amount or Security deposits what so ever. A Police Complaint will also be lodged.

While alcohol consumption is permitted, it is MANDATORY that each individual consuming alcohol has alcohol consumption permit. Beer Kegs NOT permitted.

House parties, reception and other such events are prohibited unless explicit written permission is taken for the same. If Permitted, Additional security deposit will be charged.

Any breach or violation of any of the terms of this Booking Confirmation by the Guest or his Party will render the Guest and his party liable to be immediately vacated from the Premises and No refund shall be due or made in such a case.

Standard Check-In and Check-Out Timing :

Unless otherwise confirmed in writing earlier, standard Check-In time is 2:00 PM. Guests shall not proceed to the rental property prior to standard or agreed Check-In time as stated on Booking Confirmation. Guest may be charged one additional day rental if property is occupied prior to standard or agreed Check-In time.

Unless otherwise confirmed in writing earlier standard Check-Out time is 11:00 AM. If an alternate Check-Out time is agreed, it shall be as indicated on the Booking Confirmation. Guest may be charged one additional days rental if Check-Out is delayed beyond standard or agreed Check-Out time.

Right of Admission and Admission Control :

Right of admission is absolutely reserved by the Property Owner. The information and profile provided to Cube Retreats,,,, & its Owners by person making the booking about the Guest and his /her party will be passed on to the relevant Property Owner or other persons necessary for arranging your accommodation or other services. Guests who misrepresent themselves shall be removed / ejected from the Property by the Owner or his agents with no refund of the Booking Amount paid by the Guest.

Occupancy numbers are strictly enforced. Total number of persons in the Guest’s party, including his daytime visitors shall NOT exceed “Total Pax” stated on the Booking Confirmation. If Total Number in the party exceeds ”Total Pax” stated on the Booking Confirmation, the Owner may refuse entry to the Guest and his party and if the Guest has already Checked-In, remove / evict the Guest and his party from the Property without recourse to any refund. The Property Owner may permit, at his discretion, additional persons on charging additional amount.

Security Deposit, Charges and Damages :

Security deposit equivalent to a minimum of Rs. 10,000/- or a sum at least 20% of the total Booking Amount may be charged at the time of booking. Additional security may be charged for Pets.

The guest can choose to make this make this payment via conventional routes like cash, cheque, and bank transfer.

The security deposit if paid conventionally will be refunded within 15 days after Check-Out in the form of a Account Payee cheque after adjusting / recovering charges, if any, e.g. charges for damage, excessive cleaning, furniture resetting, unnecessary service calls etc. If the charges exceed the amount of security deposit, the excess charges will be billed to the Guest and Guest will be liable to pay the same and shall pay the same without further delay from their side.

Guests are responsible for leaving the Property in good order before departure.

Guest is and shall be responsible for any damage caused to the Property, appliances, furniture, fittings, artefacts etc. during their stay.

Before Checking-Out or going out of the Property, the Guest shall make sure that all doors and windows are locked, all appliances & equipment e.g. air conditioning, heater, lights, fans, gas burners, cooking ranges, Owens, dish washers, etc. are turned off. Also ensure that all water taps and faucets are turned off; furniture returned to their original locations etc. Guest shall leave the Property in a reasonably clean state and not in a messy condition. Failure to comply with the above shall result in extra charges plus applicable taxes, if any.

It is the responsibility of the Guest to observe and report any damage to the property or appliances, furniture, fixtures and artefacts thereof within 30 minutes of Checking-In. Unreported problems and / or damages shall be assumed to have occurred during occupancy by the Guest and the Guest shall be held responsible for those damages and resulting charges.

Pets Policy :

Our website clearly indicate Pets policy of the Property, however, admission of pets will always be at sole discretion and permission of the Property Owner. Such permission must be obtained at the time of Booking. If pets are allowed, there is an additional non-refundable pet fee of Rs. 1,000 per pet per night plus applicable Taxes, if any.

All pets must be kept on the Property. It is the Guest’s responsibility to ensure that Pets do not soil or spoil the Property, its furnishings, appliances or equipment. Guests (including Guest’s day visitors) who bring pets without prior approval will be subject to pet fees, additional cleaning fees and possible removal from the property without recourse to refund, at the sole discretion of the Property’s Owner.

Refunds and Reassignments :

NO REFUNDS will be made for appliance, Air Conditioning, mechanical, drainage, water system, utility (electricity or water supply) or other failures or breakdowns. However, we will use our best efforts to have such failures or breakdown corrected as soon as possible, but cannot control the scheduling of outside service contractors. We shall have the right to arrange, inspect and make repairs during rental period.

If the rental property becomes unavailable or uninhabitable, we reserve the right to move The Guest to a comparable location accommodating the same number of persons and within the same price range. If a property in comparable price range is not available additional charges may have to be paid by the Guest for alternate accommodation.

This Booking and issues arising out of it shall be governed by, and construed in accordance with, the laws of the Union of India and subject to the jurisdiction of the courts of Mumbai as applicable, without regard to the principles of conflicts to law of any other jurisdiction.
